Resumo
As tecnologias disruptivas estão se expandindo e o fluxo de informação está aumentando. Devido às novas tecnologias, estamos enfrentando desafios inadiáveis e mudanças constantes. No entanto, a lei, como a meta-tecnologia crucial para a quarta revolução, ainda prospera em um mundo algorítmico e baseado em dados. A lei se ajusta às novas realidades, estabelecendo o que deveria ser na sociedade e sendo remodelada por desenvolvimentos progressivos. Como um espelho de vida, agora reflete um mundo interconectado, cosmopolita e global. Como resultado, seguindo os desejos e necessidades dos mercados e sociedades, corporações, particulares, universidades e até mesmo governos e pessoas naturais estão em um processo constante de criação de regras jurídicas globais. Um processo semelhante à Lex Mercatoria, capaz de enquadrar de forma efetiva os avanços rápidos como um processo jurídico autopoiético - agora conduzido por participantes não tradicionais. Uma variedade de tecnologias e processos estão sendo incorporados à lei, como resolução de disputas por meio de algoritmos, contratos internacionais simplificados, sanções sociais "quase jurídicas" amplamente divulgadas pelas mídias sociais, proteção de propriedade intelectual, especialmente através do uso de aprendizado de máquina, inteligência artificial e tecnologias autônomas, crescendo em importância e sendo materializadas de formas previamente inconcebíveis. Vinculativo e auto-aplicável, o remodelado estado de direito segue as expectativas da sociedade, enquadrando tecnologias autônomas e inteligência artificial, mas sendo enquadrado por elas, garantindo nossos direitos globalmente, de forma efetiva mas inovadora.
