Resumo
Este artigo examina a complexa relação jurídica entre direitos de imagem, termos de uso, uso justo (fair use) e os limites do direito autoral no contexto da produção de arte contemporânea, especialmente na sociedade da informação. O artigo foca nas ações do artista norte-americano Richard Prince, que usou fotografias postadas por usuários do Instagram para criar telas que foram exibidas e vendidas por grandes somas de dinheiro. Prince argumentou que sua apropriação das imagens e a adição de detalhes, como comentários e curtidas, representavam uma inovação criativa e transformadora que não violava nenhum direito. Esse argumento provocou uma longa disputa jurídica sobre os limites do direito autoral e do uso justo na lei americana, o que levanta importantes questões sobre os limites da liberdade artística e os riscos de violar direitos na era digital. Com base no filtro hermenêutico que a filosofia pode oferecer, o artigo tenta conciliar os vários aspectos dessa controvérsia e oferece algumas direções para uma compreensão mais assertiva do problema do ponto de vista jurídico.
