Resumo
Este artigo examina o Direito ao Esquecimento Oncológico como instrumento jurídico indispensável à promoção da dignidade da pessoa humana, considerando o cenário de expressivos avanços na medicina e o aumento das taxas de sobrevivência. A pesquisa parte da premissa de que a cura clínica não elimina automaticamente os estigmas sociais e econômicos da doença, investigando a persistência de práticas discriminatórias no acesso a crédito e seguros. Sob uma ótica dogmática, constitucional e comparada, analisam-se os fundamentos éticos desse direito, com ênfase nos modelos normativos europeus que impõem limites temporais ao uso de dados de saúde pretéritos. Sustenta-se que a perpetuação do status de “ex-paciente” viola o livre desenvolvimento da personalidade e a eficácia dos direitos fundamentais. Conclui-se pela necessidade de positivação do Direito ao Esquecimento Oncológico como mecanismo de reintegração social plena, garantindo a isonomia material e a proteção da privacidade dos sobreviventes.
