Abstract
The traditional concept of democracy seems to be in check in the 21st century, especially in limited analysis of Information and Communication Technologies and its impacts. In Brazil, this phenomenon has become especially striking since the second decade of the current century, with the promulgation of a Civil Internet Framework and a General Data Protection Act—to name a few. As a research problem, this paper aims to discuss the impacts of the political use of the Internet and its influences not only focusing on shaping public opinion throughout electoral campaigns and elections, but on the whole deliberation process in the public sphere. Hence the need to discuss certain institutional and regulatory constraints, both in terms of content and data protection, which, while insufficient to contain all the risks arising from this new reality, convey a finetuning of this new institutional guise, which has the power to provide citizens with mechanisms to protect their informational dignity. A few aspects that regard freedom of speech as fundamental right will be analyzed and revisited to showcase the need of State intervention, to an extent, in spite of the difficulties inherent to the web. In the end, an assertive conclusion will attemptedly be extracted.
